US President-Elect, Donald Trump Settles University Fraud Case by Paying Victims a Whopping N7 Billion

US President-elect, Donald Trump

Donald J. Trump has reversed course and agreed on Friday to pay $25 million(N7 billion) to settle a series of lawsuits stemming from his defunct for-profit education venture, Trump University, finally putting to rest fraud allegations by former students, which have dogged him for years and hampered his presidential campaign.

The settlement was announced by the New York attorney general just 10 days before one of the cases, a federal class-action lawsuit in San Diego, was set to be heard by a jury.

The deal averts a potentially embarrassing and highly unusual predicament: a president-elect on trial, and possibly even taking the stand in his own defense, while scrambling to build his incoming administration. It was a remarkable concession from a real estate mogul who derides legal settlements and has mocked fellow businessmen who agree to them.

But the allegations in the case were highly unpleasant for Mr. Trump: Students paid up to $35,000 in tuition for a programs that, according to the testimony of former Trump University employees, used high-pressure sales tactics and employed unqualified instructors.

The agreement wraps together the outstanding Trump University litigation, including two federal class-action cases in San Diego, and a separate lawsuit by Eric T. Schneiderman, the New York attorney general. The complaints alleged that students were cheated out of thousands of dollars in tuition through deceptive claims about what they would learn and high-pressure sales tactics.

“I am pleased that under the terms of this settlement, every victim will receive restitution and that Donald Trump will pay up to $1 million in penalties to the State of New York for violating state education laws,” Mr. Schneiderman said in a statement.

“The victims of Trump University have waited years for today’s result, and I am pleased that their patience — and persistence — will be rewarded by this $25 million settlement.”

The settlement is a significant reversal from Mr. Trump, who had steadfastly rejected the allegations and vowed to fight the lawsuits, asserting that students filled out evaluations showing they were mostly happy with what they had learned in seminars. When political opponents pressed him on the claims during the campaign, Mr. Trump doubled down, saying he would eventually reopen Trump University.

“It’s something I could have settled many times,” Mr. Trump said during a debate in February. “I could settle it right now for very little money, but I don’t want to do it out of principle.”

He added, “The people that took the course all signed — most — many — many signed report cards saying it was fantastic, it was wonderful, it was beautiful.” But the position of Mr. Trump and his legal team appeared to soften soon after his election victory on Nov. 8.

At a hearing last week, Daniel Petrocelli, a lawyer for Mr. Trump, expressed interest in moving toward a settlement. Meanwhile, Mr. Trump’s lawyers were seeking to delay the trial in one of the California cases until after his inauguration on Jan. 20, while also requesting that he be allowed to testify on video.

At a hearing on the case in San Diego on Friday, Mr. Petrocelli said Mr. Trump had settled the case “without an acknowledgment of fault or liability.” The judge overseeing the two California cases, Gonzalo Curiel, was thrust into the limelight of the campaign in May when Mr. Trump spent several minutes at a rally denouncing the judge’s decisions in the case, calling him a “hater” and questioning his impartiality because of his Mexican heritage.

After he faced days of criticism for his remarks on the judge, Mr. Trump released a statement saying his words had been “misconstrued as a categorical attack against people of Mexican heritage.” He also asserted that he was justified in questioning the fairness of his trial, given various rulings in the case that went against him.

Still, he concluded, “we will win this case!” Judge Curiel said in court Friday that he hoped that the settlement agreement — and the end of the presidential campaign — would begin “a healing process that this country very sorely needs.”

Under the agreement, Mr. Trump will pay $21 million to settle the two California class-action suits and $4 million to settle with the New York attorney general. The lawyers for the plaintiffs waived their attorneys’ fees. The deal still has to be approved in court, which could take months.

About 7,000 students will share in the settlement, according to their lawyers. The customers will be eligible to recoup at least half of what they spent at Trump University, and some could receive a full refund, the lawyers said.

Even before he was in the throes of his presidential bid, Mr. Trump began mounting a vigorous public defense of himself and Trump University. A website, 98percentapproval.com, touted high marks it received from students.

A New York Times report in March, though, showed how some students recalled being pressured to give positive reviews. Trump University, which operated from 2004 to 2010, included free introductory seminars across the country, focusing largely on real estate investing and learning Mr. Trump’s secrets. Students could then purchase more expensive packages costing up to $35,000.

Documents made public through the litigation revealed that some former Trump University managers had given testimony about its unscrupulous and exploitative business practices. One sales executive testified that the operation was “a facade, a total lie.”

Another manager called it a “fraudulent scheme.” Other records showed how Mr. Trump had overstated the depth of his involvement in the programs.

Despite claims that Mr. Trump had handpicked instructors, he acknowledged in testimony that he had not. In addition to the financial rewards, the conclusion of the Trump University cases brings vindication to former students, mostly ordinary people across the country who felt they had been robbed of their savings by Mr. Trump, a successful businessman they respected and admired.

One student, Jeffrey Tufenkian, who enrolled with his wife to pursue a real estate career, told The New York Times in 2011 that the experience “was almost completely worthless.”

“Trump University has no interest in taking care of its customers,” said Mr. Tufenkian, who paid $35,000 for a “Gold Elite” class, which he said at the time wiped out much of his savings. Alan Garten, a lawyer for Mr. Trump, said Friday that his side was “pleased” with the settlement.

“While we have no doubt that Trump University would have prevailed at trial based on the merits of this case, resolution of these matters allows President-elect Trump to devote his full attention to the important issues facing our great nation,” he said in a statement.

Roro Enahwo in the hospital

On Wednesday November, 16, a 43-year-old man identified as Roro Enaohwo, was allegedly beaten to coma, by officials of the Vehicle Inspection Officers (VIO) who went ahead to punch the left eye of an Udu palace Chief, Monday Koru and tore his traditional beads over alleged N5,000.00 bribe in Udu LGA of Delta State.

According to a shocking report by DailyPost, Roro Enaohwo who is critically injured, has been hospitalized and receiving treatments at Divine Mercy Clinic in Ovwian, while an eye test has been conducted on Chief Monday Koru with a medical report to show.

Speaking to a correspondent on condition of anonymity, a nurse with Divine Mercy Clinic, stated that the Medical Director of the Clinic had concluded an X-ray on Enaohwo stressing that, “It is the result that will show if Enaohwo has internal bleeding and if he will be referred to another hospital for further treatments.”

Roro Enaohwo was attacked and beaten to coma while in company of his boss, Chief Monday Koru, a car dealer to the office of the VIO to plead on behalf of a commercial tricycle operator who was unlawfully apprehended and asked to part with a N5,000 bribe by the VIO officials.

It was gathered that Chief Monday Koru pleaded with VIO to settle the case of the tricycle operator for peace to reign by accepting N3,000, but the Head of the VIO (name withheld) sent his subordinate to follow him (Chief Koru) to his house in his car to collect the money.

Two hours later, the tricycle operator reported back to the office of Chief Monday Koru that his tricycle had not been released to him by the VIO official after they collected the three thousand naira.

Pained by the development, the chief and his boys approached the VIO Officials requesting for the release of the tricycle but they said he must pay the remaining N2000 before the release of the tricycle. The development resulted in a hot argument between Chief Monday Koru and the VIO official who allegedly attacked him and his boys.

Chief Koru with one of his boys managed to escape from the premises of the VIO who locked their gate but his boy, Roro Enaohwo was not lucky as he was beaten blue and black.

Sensing that they have committed an offence when Roro Enaohwo had gone into coma, Officials of the VIO started pouring cold water on him with a view to reviving him but it took the intervention of the Police from Ovwian /Aladja Police Divisional Headquarters on the orders of the Divisional Police Officer, CSP Dike Albert Uchechi to rescue the victim and rushed him to Divine Mercy Clinic in Ovwian, Udu Local Government Area of Delta State.

Narrating his own side of the incident to our reporter, Chief Monday Koru said, “V.I.O arrested a keke driver and my attention was called to the matter and when I got there, I pleaded with three thousand naira, but the cash was not with me there so the person in charge asked one of his boys to follow me to my office to collect the three thousand naira.

“After two hours, they didn’t release the keke , so I went back to their office and the person in charge walked me out of his office and asked me why I didn’t knock before entering his office, and that I should pay five thousand naira before he release the keke while the three thousand is with them , then his boy started beating me and my boys up.

One of my boys was beaten up almost to the point of death, the boy has internal bleeding now, it was the intervention of the police that the boy was rescued and he his currently receiving treatment in the hospital. Meanwhile, the money and the Keke are still with them.”

The Public Relations Officer of Udu Union of Communities, Chief Andrew Oyovwiraye accused the VIO Officials of allegedly perpetuating criminality and demanding bribes from road users instead of their vehicle particulars, stressing, “I was a victim last week. I had to query them before I left them.”

Nigeria Ranked Third Most Terrorised Nation in the World

Nigeria is still ranked third among the countries in the world that have been worst hit by terror attacks, according to the 2016 Global Terrorism Index (GTI) report.

The GTI monitored and measured the impacts of terrorism in 163 countries, covering 99.7 per cent of the world’s population. Nigeria had occupied the same position in last year’s ranking, and was ranked fourth in 2014.

For 2016, Nigeria ranked behind Iraq and Afghanistan. Pakistan, Syria, Yemen, Somalia and India are ranked fourth, fifth, sixth, seventh and eighth respectively, while Egypt and Libya are in the ninth and 10th position, in the latest ranking.

The report, released on Wednesday by the Institute for Economics and Peace, however indicates a 34 per cent decline in the number of people killed by the terrorist group, Boko Haram, in 2015 in Nigeria.

The total number of people killed by Boko Haram in 2015 was 4,095, down from the 6,136 in 2014, said the report which attributed the decline to the operation of the Nigerian military and the Joint Task Force in the north-east of the country.

According to the report, Nigeria also had a reduction in the number of people killed by Fulani militants (herdsmen).

“There were 630 fewer deaths by these militias in 2015, a decrease of 50 per cent,” the report said. This, according to the report, contributed to the overall 10 per cent drop in the number of deaths caused by terrorism globally. In fact, the report says Iraq and Nigeria had the largest reduction on deaths from terrorism from 2014 to 2015.

The gains made against Boko Haram by the Nigerian military, however became the pains of the country’s neighbours – Niger and Cameroon – as the terrorist group spilled over and created more deaths in the two countries than previously recorded.

“Niger recorded a devastating year with 11 terrorism deaths in 2014 rising to 649 in 2015. This is the largest proportional increase of any country and is due to the expansion of Boko Haram,” the report said.

Niger is now 16th in the latest ranking, compared to the 51st position it occupied in last year. The deteriorating terrorism attacks in Cameroon also moved it from 20th position it was in 2015 to 14th in 2016. ISIL, the Islamic militant group in Iraq, has now overtaken Boko Haram as the deadliest terrorist group in 2015, the report said.

The report said, “Despite the decrease in deaths from terrorism, Nigeria still experienced a high rate of violent deaths. “In addition to terrorism victims, there were at least 4,422 battle-related deaths from the conflict between Boko Haram and the Nigerian Government in 2015, down from 8,233 in 2014.”

The report said on the average, Boko Haram killed 11 people per attack in Nigeria, and that the attacks were mainly targeted at civilians. “Four out of five deaths from terrorism in Nigeria are civilians,” it said.

“This is one of the highest targeting of civilians anywhere in the world. “Whilst the majority of fatalities were caused by armed assaults with firearms and knives, there has been an increase in the use of bombings and explosions, a tactic Boko Haram has been increasingly using after receiving explosives training from al-Shabaab.

“In 2013, Boko Haram conducted 35 bombings which killed 107 people. In 2015 there were 156 bombings that killed 1,638. Nearly two thirds of the bombings in 2015 were suicide bombings, which on average killed ten people per attack,” the report said.

Out of 20 most fatal terrorist attacks in the world in 2015, according to the report, four occurred on the Nigerian soil, with Boko Haram being responsible for three. Fulani militants were responsible for one – where 95 people were killed in a single attack on March 15, 2015.

According to the report, the worst terrorist attack in Nigeria occurred on September 13, 2015 when Boko Haram killed 160 villagers in Kukuwa-Gari village by gunfire or drowning. A total of 174 people were killed in the attack, the report said.

The report put the global economic impact of terrorism at US$89.6 billion in 2015. Foreign Direct Investments (FDI) to developing economies such as Nigeria is directly affected by terrorist attacks, it said. “Unlike ISIL, Boko Haram does not have a sophisticated financing structure,” says the report.

“The primary revenue source for Boko Haram is kidnapping, ransom and extortion.” The group is also said to rely on bank robberies, illegal mining, external donations, and drugs for its income which is said to be up to $25 million, annually.

The report put the total number of people killed in Nigeria by Boko Haram at 17,097 since 2000. The administration of President Muhammadu Buhari has obviously achieved some successes in its war against terrorism, but the Boko Haram sect hasn’t been defeated yet, as repeatedly claimed by the Nigerian authorities. The report explains the methodology used in developing the terrorism index.

“The GTI ranks 163 countries based on four indicators weighted over five years. “The GTI score for a country in a given year is a based on a unique scoring system to account for the relative impact of incidents in the year.

What Nigerians Must Do to Get UN Jobs - UN Director Human Resources Reveals

File photo: UN Workers

The UN has challenged Nigeria to push its qualified citizens forward for appointment and employment positions at the UN.

The Director, Learning, Development and Human Resource Services of the UN, Victor Kisob, threw the challenge when Joan Ayo, Chairman, Federal Civil Service Commission, visited him.

Ms. Ayo had led a delegation from the commission and Nigeria’s Permanent Mission to the UN to Mr. Kisob on job opportunities for Nigerians, lamenting the country’s under-representation at the organisation.

Mr. Kisob told the UN correspondent of the News Agency of Nigeria that the UN encouraged Nigerians to apply for jobs especially in the middle and senior cadres.

“We still encourage Nigerians to apply for positions because we always look for the best and I believe that Nigeria has quite a reservoir of very qualified people in all fields of endeavours that the organisation looks for.

“What I will encourage is for those who are in mid-career or senior levels to also look at positions within the organisation when we do advertise them because certainly we don’t have experienced Nigerians at senior levels, directors and above level. “That’s where I think I don’t see there are many Nigerians but it will be good for us to also have them apply for positions at that level.

“The government of Nigeria plays a role when it comes to positions at the Assistant-Secretary-General level and the Under-Secretary-General levels which the Secretary-General himself appoints individuals. “That’s where the leadership of the country can interact directly with the Secretary-General and putting forward names of people the government believes are qualified to work at such levels in the organisation.

“We do advertise the positions on the website when they come and we then also inform the Permanent Mission here in New York of the availability of positions at the high levels.”

The UN official pointed out that Nigeria had so many qualified citizens who could serve at the UN but wondered why they are not in the employment of the UN. He said Senegal has five Under-Secretaries-General and the Secretary-General of FIFA while Ethiopia has four Under-Secretaries-General at the UN.

According to him, many African countries have special departments responsible for the recruitment of their nationals into key international positions. Mr. Kisob also urged Nigeria to use its strategic position to “take” international posts rather than wait for it to be given, advising the country to also push its best female candidates for the AU Chairman rather than rely on consensus.

“The government has to understand that it has to play a global role, not just regional role, and you need to go back and re-strategise. “Our Heads of State need to keep putting up candidates who are qualified, especially women. The secretary-general has said ‘give me women who are qualified and I will appoint them’.

“It’s been a long time since Prof. Ibrahim Gambari left the UN but his fingerprints are still everywhere in the UN,” he said.

Also speaking with NAN after the meeting, Ms. Ayo said she was at the UN “to share ideas to see how we can leverage into whatever UN is doing to improve on the situation in Nigeria.

“I came out with three strong points that I believe we should work on at home. First, that our government should be more proactive in sponsoring people to work in the UN. “We raised the issue that we do not have sufficient representation and the Director brought out two or three issues.

“The first one is that several governments identify people of integrity and of intellectual capability and they push them and so they get the UN job.

“Another issue that he raised that I think we should look into is to have a database of such people at our fingertips because they are now coalescing on behalf of Africans such database that can be useful to them at this level and this environment that they too can push.

“And finally, I saw an opportunity which I’ve been looking for them to download all jobs vacancies so that I too can advertise them on FCSC’s website. Those are three things that I’m going back home with.”

Ms. Ayo had, at the meeting with the UN official, lamented over what she termed deficit in Nigeria’s representation at the UN.
